Role of the Association of Prince Edward Island Land Surveyors
The Association of Prince Edward Island Land Surveyors (APEILS) is established under the Land Surveyors Act and is delegated authority by the province to regulate the profession of land surveying, ensuring public protection and service. This includes overseeing complaints and disciplinary actions related to members of the Association.
Membership and Compliance Requirements
All members of the Association are required to adhere to the relevant laws, regulations, and by-laws governing the practice of land surveying, including but not limited to:
- The Land Surveyors Act
- The Land Survey Act
- The By-Laws of the Association of Prince Edward Island Land Surveyors
Failure to comply with these requirements may form the basis for a formal complaint.
Limitations of the Association's Role
While the Association plays a key role in regulating land surveyors, there are limits to the services it can provide. Specifically, the Association cannot:
- Offer land surveying advice.
- Compel a land surveyor to change a survey or plan.
- Adjudicate boundary disputes.
- Provide compensation or force a land surveyor to provide compensation for errors.
If you believe a land surveyor has made a mistake, it is recommended to seek a second opinion. Any monetary claims related to mistakes or disputes must be addressed through the courts.
Filing a Complaint
Communication and Resolution
Before filing a complaint, we encourage you to discuss your concerns directly with the land surveyor. Many misunderstandings arise from communication gaps and can often be resolved through open dialogue. If you have questions about land surveying or concerns about the services provided by a land surveyor, please contact the Association for further guidance.
